The Ministry of Finance of the Russian Federation has suggested to strict rules of tax residency in its Draft Law of National budget on 2020-2022.
Document proposes to set more flexible rules of tax residency and introduces new criteria – centre of vital interests.
New criteria will be applicable in case when the period of persons presence in country shorter than 183 days during the year. It is necessary to take into consideration the owning of real estate, personal and economic relation, domicile and citizenship in determining of the person’s centre of vital interests.
The Ministry of Finance is planning to reduce the period of presence in Russia to consider person as a tax resident from 183 to 90 days during the year. Equalizing of 13% rates on personal income tax for residents and non-residents is also in the Draft Law.
