On March 20th, 2018, the EU Council approved the adoption of the Directive on the creation of an International Court of Justice for the resolving of investment disputes.
The formation of a permanent body to resolve investment disputes will replace the bilateral system of investment ships included in the EU trade and investment agreements. For example, it concerns the Comprehensive Economic Trade Agreement between the EU and Canada as well as the Free Trade Agreement between the EU and Vietnam, which provides the creation of a permanent investment dispute resolution body.
