The European Commission deprives Belgium of a number of advantages of tax system

04.05.2012 The government of Belgium received formal inquiry from the European Commission about modification of the legislation on the taxation of profit of the companies and tax on inheritance.

At the moment the regional legislation of Brussels and the Walloon gives the opportunity of a choice of a method of estimation of cost of actions that forms base for calculation of a tax on inheritance. However this option is possible only for actions which are quoted in the Belgian stock market. For foreign actions, cost pays off, only proceeding from their market quotation at date of death of their owner.

Also according to the Belgian corporate legislation, the local companies obtain the tax credit to 3750 euros. At the same time, the Belgian representations of the foreign companies are deprived of this right.

Expert’s opinion

«The European Commission came to a conclusion that these privileges are discrimination in relation to foreign business, therefore it demands their revision.
And though in Belgium sufficient high rates of the taxation, the country is interesting, first of all, from the point of view of the possibility of receiving of residence permit and further for receiving Belgian nationality.»
